This pivotal legislation comes at a crucial time, just as South Africans were gearing up for the polls. and make marijuana legal in South Africa but...

Up until late on 28 May 2024, the Drugs and Drug Trafficking Control Act provided the following:

“No person shall use or have in his possession— any dangerous dependence-producing substance or any undesirable dependence-producing substance…” which included “cannabis (dagga), the whole plant or any portion or product thereof, except dronabinol [(-)-transdelta-9-tetrahydrocannabinol].

but now this new law entirely remove cannabis from the Drugs and Drug Trafficking Act.

Understanding the New Cannabis Legislation

The new law is a game-changer, allowing adults to possess, use, and grow cannabis within the privacy of their homes. While it stops short of legalizing the sale of cannabis, it represents a major shift from the country’s previous stance under the Drugs and Trafficking Act.

The Constitutional Court’s Influence

This legislative change is a direct response to the 2018 Constitutional Court ruling, which deemed the prohibition of the private possession and cultivation of cannabis unconstitutional. The court’s decision mandated legislative amendments within two years, leading to the current law.

Economic and Social Implications

The law is more than just a nod to personal freedom; it’s a strategic move to integrate cannabis into South Africa’s economy. The government’s vision is to industrialize cannabis production, potentially creating over 100,000 jobs and fostering economic development.

Safeguarding the Youth

A key aspect of the law is the protection it offers to minors. It includes provisions for medically prescribed cannabis for children while ensuring they are shielded from unnecessary exposure to the plant. The law also proposes alternative approaches to dealing with cases involving minors and cannabis, prioritizing the child’s welfare.

The Road Ahead

While the current law does not permit commercial trade, it lays the groundwork for future regulations that could establish a legal cannabis market in South Africa. This aligns with President Ramaphosa’s broader economic plans, which he highlighted in his 2022 state of the nation address.

The Legislative Process

The journey to legalize cannabis has been a lengthy one, with the initial draft of the bill introduced in 2020. After facing several delays and revisions, the bill has finally been enacted, marking a historic moment in South Africa’s legislative history.

Conclusion

The enactment of the Cannabis for Private Purpose Bill is a landmark achievement for South Africa, signaling a shift towards more liberal drug policies and opening doors to economic opportunities within the cannabis industry. As the nation progresses, it will be essential to maintain a balance between regulation, economic interests, and public health and safety.
